Finca 2 Beds With Land

A modern (built 1992) two bedroom country house/cortijo with land, located between Lanjaron and the motorway running from Granada city to the coast. The house has 105 m2 built and consists of a large living room-dining room with fireplace and open plan kitchen, a shower room, a w.c., two bedrooms and a large utility room. A covered terrace, including a barbecue area, runs the length of the south side of the house, with fine views. At the back of the house is an extensive patio/parking area, with a car port. The land is of hillside and level land, with olive and other fruit trees, and irrigation water. This water comes from a spring at the edge of the land and is pumped up to water tanks above and behind the house, for domestic use. The house has electricity connected. Built with a licence for a smaller agricultural building in 1992, the cortijo was never included in the title deed. The current owner has decided not to carry out the process of legalization of the building as a dwelling, instead leaving it to a purchaser to decide whether or not to do this, post-purchase. A wind company has 20% of the title to the property... This consists principally of the plot of land above the road, adjacent to the electricity sub station on the north side of the road The situation is that the building is not on the title deed  but the town hall of el Pinar has told me that it can be legalised as an AFO ( asimilación fuera de ordenación) The part owned by the wind company (Solwindet las Lomas S.A:, see attached nota simple).....in 2003 the owner sold right of way over the land for underground and overground cables ( see attached plan) . In 2004 the owner sold 20% of the title to the wind company, without any specification which part. I have been in touch with the wind company and they tell me that they are principally interested in the land above the road ( plot 6 according to the catastro plans, attached. Note although the catastro shows two plots of land, plots 6 and 182, in the title deed there is only one plot of land, that shown  in the black and white plan, which includes the plots 6, 182 of the catastro). I am in dialogue with the wind company´s lawyers, and they have told me that they could prepare a document clarifying their current interest in the property.
Since the  right of way agreement of 2003 and the purchase of 20% of the title in 2004 the wind company have not used any part of the land, despite there having been built a number of wind generators nearby ( see Google maps aerial photos... the windmills are to the east right  of the finca.
